Joint TCM/A Associations Release Opioid Letter to Ontario’s Minister of Health and Long-Term Care

In response to the letter released by the Ministry of Health and Long-Term Care Care, concerning the growing opioid addiction problem in Ontario, The Chinese Medicine and Acupuncture Association of Canada (CMAAC), the Canadian Society of Chinese Medicine and Acupuncture (CSCMA), the Association of Traditional Chinese Medicine Practitioners and Acupuncturists of Ontario (ATCMPAO), and the Traditional Chinese Medicine Ontario (TCMO) working group united to release a joint letter to Ontario’s Minister of Health and Long-Term Care, the Honourable Eric Hoskins. The purpose was to collaborate in an effort to combat the current crisis of opioid addiction in the province.

Do you have the right insurance coverage?

Many regulated Practitioner’s in Canada are required to carry a minimum of $1,000,000 plus malpractice (Errors & Omissions) liability insurance. However this may not be the only insurance that you should be purchasing to protect you or your business from financial loss in case of a claim. Whether practicing as a sole practitioner or operating with others in an office/clinic environment we have prepared the following insurance checklist to assist you in your decision on how best to protect your financial interests as a practicing Doctor.

Malpractice Professional Errors & Omissions Liability Insurance

All licensed medical practitioners’ in Canada are required to carry a minimum of $1,000,000 to $5,000,000 Malpractice (E &O liability)

Additional Named Insured under Malpractice Professional Errors & Omissions Liability Insurance

If you operate your practice under a separate name this name should be added to your personal Malpractice policy. This would also protect the clinic name for claims generated by other professional practitioners working in your clinic. Please note that each professional practitioner working in your clinic must carry their own personal Malpractice Insurance for minimum limits of $1,000,000. Students working under the guidance of a Licensed Professional Practitioner would be exempt from this requirement.

Commercial General Legal Liability Insurance

Commercial General Liability insures you for slip and fall claims. For example, if your patient should happen to hurt themselves coming onto your premises or falls while getting on or off the examining table. This would be beyond your Professional Liability Policy Malpractice Insurance. It is important to note that this policy provides insurance for products liability. In most instances this is insured under your Malpractice liability policy, but if your clinic offers services non-related to your practice you may be at risk. We have found that business office/clinic policies purchased outside of the insurance program exclude this coverage.

Office/Clinic Business Package (Including Commercial General Legal Liability)

This provides insurance for the practitioner who operates their own office or business clinic and requires more extensive insurance coverage. It includes Commercial General Legal Liability, Property and Crime Insurance.

Cyber Cover

This protects you and your practice for the forensic and legal expense to investigate and secure security leaks including liability from patents and or other third parties if their medical files or credit cards have been compromised.

Legal Expense

This is personal legal expense insurance coverage. This allows you to contact a lawyer primarily for telephone consulting where legal advice can be provided for both business and personal matters.

WFAS Expanding

Dear member societies,

Until 30 September 2016, WFAS Secretariat had received 3 applications from 3 countries/regions for WFAS membership, and 3 of which were considered qualified after a preliminary screening by the Secretariat and then a review by the Membership Qualification Committee in line with WFAS Constitution. After correspondence voting by the EC members, 3 applicants won more than half of votes in the affirmative, hence are officially accepted as members of WFAS. They are:

  1. Pan European Federation of TCM Societies(PEFOTS), , the Netherland
  2. Association of Qigong for Health, Tao’s Heart, Spain
  3. ALK Acupuncture and Physiotherapy School, Brazil

Blue Cross now allows Direct Billing

Acupuncturists can now direct bill to Blue Cross Insurance for their patients’ treatments.

Practitioners must first register with Blue Cross to obtain a Provider number (this is needed whether doing direct online billing or whether your patient is submitting the forms manually).

This includes BOTH regulated and unregulated provinces!

GST/HST exemption for acupuncture services

Exciting news from Revenue Canada! 

The Revenue Canada Excise Tax Act (the Act) provides a GST/HST exemption for a supply of acupuncture services made after February 11, 2014, if the acupuncture service is rendered to an individual by a practitioner of acupuncture.

  • A “practitioner” of acupuncture is defined in Part II of Schedule V to the Act to mean a person who practises the profession of acupuncture and is either:
    • licensed or certified to practise the profession of acupuncture by a provincially established regulatory body if the acupuncture service is supplied in a province that regulates the profession of acupuncture; or
    • has the qualifications equivalent to those necessary to be licensed or certified in another province if the acupuncture service is supplied in a province that does not regulate the profession of acupuncture.
