致中醫界同仁的公開信
珍惜成果着眼大局,支持审批早日注册。
各位中医界同仁及关心中医立法的朋友们:安省中医针灸立法规管要经歷求法、立法、建制、规管四个时期。自上个世纪七十年代安省中医针灸同仁们就开始漫长的求法、立法跋涉,经过30年之久的奋斗,得到三大政党及各界人士的支持,2006年12月20日,安省50号议案「中医法案2006」 被皇家审批通过;安省继卑诗省成为加国第二个完整中医立法管制的省份。
法案只是一个框架,还需有人(机构)做大量的具体工作来落实和实施。遵照2006年中医法案条例,安省传统中医师及针灸师管理局过渡委员会(以下简称“过渡委员会”)在2008年6月成立,省政府经多方甄选出过渡委员会委员,既有业界代表也有公眾代表,开始了建制期。
经过两年多的辛勤工作,安省中医立法规管的建制工作已近尾声,“中医针灸师註册规章及职业操守草案”经60天公示期并在反繢意见基础上进行了修改,现已提交给卫生厅,待批时间约需12-16个月,批准后就可进入註册规管期。
我们非常感谢过渡委员会,在过去的两年中所做的大量细緻工作;我们坚决支持并要求加速卫生厅审批的进程,尽快完成管理局的注册。我们只有尽早获得注册针灸师中医师专业人员的地位,才能享有和进一步争取保险利益,病人税务报销,专业税法豁免。这样既可保障公眾求医的权益,也有助中医界同仁的利益,这也是我们争取中医立法的基本诉求。管理局的立法工作具有开拓性,确需中医界同仁的支持和参与;我们应该建议和帮助管理局将立法规管做得尽量完善;而不愿看到因误导,将管理局打倒推翻解散,使中医立法再次流產,将立法倒退回上个世纪或被迫取消;这不是我们中医界大多数同仁的诉求,也不符和保障公眾利益的要求。安省中医针灸立法走到今天,己是大势所趋民心所向,让歷史倒退几乎不可能。对话协商是现代文明社会解决矛盾的主要方法之一,打倒解散管理局是很情绪化不理智的做法。珍惜中医界全体同仁几十年奋斗的成果,着眼大局支持立法,加速审批和争取早日注册,不仅顺应歷史的发展潮流,也应符合公眾和业者的利益。
Since 1970, practitioners in Ontario have been advocating for the regulation of traditional Chinese medicine and acupuncture (TCM/A). All three major political parties in Ontario and the general public have supported the regulation of TCM/A. December 20, 2006 saw the Royal Assent of the “Traditional Chinese Medicine Act, 2006” regulating TCM/A under the Regulated Health Professions Act, 1999 and beginning the regulation process. Ontario became the second province in Canada to regulate TCM/A, after British Columbia. The TCM Act is just the framework for regulation and established a regulatory College to develop the regulations and protocols to practice TCM/A in Ontario. The TCM Act established the transitional Council of the College of Traditional Chinese Medicine Practitioners and Acupuncturists of Ontario (TC-CTCMPAO), which is responsible for developing the regulations. The members of TC-CTCMPAO were appointed in June 2008 and have been working to develop the regulations since then.
After two years of hard work, the regulations for TCM/A in Ontario are almost complete. Draft registration regulations and professional misconduct regulations were completed and circulated in the public for 60 days for feedback. The feedback received was used to modify the regulations before they were submitted to the minister of Health and Long-Term Care for final approval. The final approval by the Minister will take 12-16 months.
We are grateful to TC-CTCMPAO for the hard work they have completed over the past two years. We strongly support the Ministry of Health and Long-Term Care and request approval of the regulations as soon as possible so that practitioner may begin to register with CT-CTCMPAO. Once practitioners begin to register with TC-CTCMPAO, we will be able to lobby insurance companies to cover more TCM/A services, lobby government for tax reimbursement of patients and professional tax exemption. Registration will protect the public in seeking treatment, but also help the interests of TCM/A profession, promoting and elevating the profession to a higher standard. This is our basic demand for legislation. We should be involved in offering suggestions and help the transitional Council accomplishits work on regulatory development. We do not want to see the dismantling of the transitionalCouncil or aborting the progress toward regulation due to misinformation. It is not the desireof the majority of TCM practitioners to bring regulation to a halt and revert back to the lastdecade.
We should not take regressive steps. Dialogue to resolve controversy is the way to go. It is emotional and illogical to strike down and dissolve the transitional Council. Treasure the result of 30 years work. Support regulation; support accelerated approval of the regulations; strive for early registration for the greater interest of the public.

爭取聯邦政府豁免中醫界服務稅
Susan Makray, D. TCM, and Prof. Bing Jiang Wu attended a meeting on behalf of CMAAC on February 11-12, 2011 at the Strathcona Hotel in Toronto, Ontario. The purpose of the meeting was to meet to strategize how to lobby the government to have TCM/A services removed from the HST. The Hon. Yonah Martin and the Hon. Rev. Don Meredith, members of the Canadian Senate, were in attendance at the meeting. As a result of this meeting, the Canadian Coalition of TCM and Acupuncture Associations was formed. The members include;

· Association of Acupuncturists of Quebec
· Chinese Medicine and Acupuncture Association of Canada
· College and Association of Acupuncturists of Alberta
· Chinese Medicine and Acupuncture Association of Newfoundland and Labrador
· Canadian Society of Chinese Medicine and Acupuncture
· Qualified Acupuncturist and TCM Practitioners Association of British Columbia
This coalition has been formed to request the removal of the HST from the treatment of Acupuncture by a TCM and Acupuncture provider. Once such a profession is regulated as a health profession by at least five provinces, services of that profession will be exempt from the GST-HST. This exemption must be requested, and supported unanimously by the practitioners before this process can begin. As Newfoundland and Labrador have just recently received their royal assent, they now make up the 5th province and enable us to qualify for this exemption. The request has been sent and we should have more information to provide to you in the next CMAAC newsletter.

这个联合会的成立目的是为了争取豁免中医针灸的服务税HST。一旦中医针灸成为5个省份注册管理的行业时,服务税 GST-HST就可豁免。
这种豁免必须在业者一致的支持和請求下方可通过。最近纽芬兰省和拉布拉多省已得到皇家的同意,组成五省并创造条件使我们通过服务税的豁免。此情求已递交到政府机构,我们将在下一期会刊中告知您进一步的消息。
安省中醫過渡委員會 盼後年成立規管局

安省中醫師及針灸師管理局過渡委員會(簡稱過渡委員會)註冊總監張關亮冰表示,過渡委員會已通過向安省衛生及長期護理廳遞交規章草案,預計 省衛生廳需時12至18個月審閱研究,然後再遞交給省議會內閣審批,希望可在2013年正式成立正式的規管局。過渡委員會又會在今年底或明年初舉辦有關中
醫的安全及法律課程。
張關亮冰在昨日過渡委員會的第12輪會議上稱,委員會已向安省衛生及長期護理廳遞交規章草案。她透露,專業 操守規章草案未作改動,只是在註冊規章草案作一些非實質性修改,對政策並無影響。當中所作的改動是採納了中醫界、公眾、利益團體、安省醫療規管機構、安省
公平專員辦公室以及省政府的意見。對於業界的疑慮,過渡委員會對有關祖輩註冊的數項說明加入了詳盡的解釋。
張關亮冰表示,就有關祖輩註冊中,其中要求申請者需有2,000名病人診症病歷一項共收到千餘份回應及意見,過渡委員會為解決中醫界對如何展示安省 經驗方面的疑慮,經修改後的說明提供了各種證明展示方法,包括文件的合理組合,如個人或診所在市政府的註冊、公共衛生檢查、商業註冊、法庭宣誓文件、專業 責任保險、購買草藥、儀器、及設備等單據。另外,病人及約診紀錄,以及報稅表及財務報告等。而有關祖輩註冊的語言要求一項,省政府表示過渡委員會已經做了 應做的工作。
張關亮冰表示,衛生及長期護理廳的政策分析員和律師將審核過渡委員會呈交的規章草案,以確保該草案與省政府政策及立法一致,然後再遞交給省議會內閣 審批。估計需時約12至18個月。希望可在2013年正式成立規管局。在這段時間,過渡委員會將與衛生廳緊密溝通,研究有些細節是否需要改動或修正。但規 章草案的總體意向,省政府是不會改變的。
張關亮冰稱,為支持祖輩會員不斷提升水平和持續學習,過渡委員會制定的「既有學術的認可」(Prior Learning Assessment and Recognition 簡稱:PLAR程序),亦是用作對轉為全面註冊的祖輩中醫進行評估上。過渡委員會已委任一個顧問小組來制定工具及程序,用來確定一個祖輩會員是否具備了成 為正式註冊會員的基礎專業能力。目前正在考慮的程序包括:有關經驗和培訓方面的書面證據、個人資料審核及口頭面談等。張關亮冰表示,過渡委員會的顧問小組與卑詩省的專上教育機構就有關開辦中醫課程事宜有初步接觸,委員會計劃將於本年底或明年初,為業界申請者開辦安程課程及法律課程,有關細則仍在擬訂中。

This seminar will give an introduction to CMAAC members on the Canadian Health Care Anti-fraud Association. Issues such as protecting our practice from fraud, how health care fraud has an impact on the Canadian health care system and how we can help to prevent it, will be addressed. This topic is important in promoting professionalism in our TCM community, and we urge our members to attend and participate. Chinese translation will be provided. 本次講座欲将“加拿大保健系统反欺诈联盟(协会)”介绍给我们CMAAC的会员。该协会将派人介绍的内容:如何保护我们在健康服务领域里被欺诈,医疗欺诈对加拿大的医疗保健的影响,以及我们如何能够帮助阻止及解决医疗欺诈。这是一个促进中医界迈向专业的重要课题(影像),我们要求会员勇跃参加。研究会将提供中文译本。
