CMAAC Information Session信息會議
The Chinese Medicine and Acupuncture Association of Canada (CMAAC) is pleased to announce that we shall be holding another information session on the regulation progress of theTransitional Council of the College of Traditional Chinese Medicine Practitioners and Acupuncturists of Ontario and grandfather law. CMAAC members, as well as members of the public and the traditional Chinese medicine community, are invited to attend this important information session. At this third session, Ms. Cheung will be briefing those in attendance of the Transitional Council's recent work and grandfather law. The drafted Registration Regulation and Professional Misconduct Regulation will be reviewed. There is limited seating, so please purchase tickets in advance. 中醫立法草案增彈性 60天諮詢期展開 |

【明報專訊】本省中醫師及針灸師的註冊條例草 案昨日正式出爐，安省中醫師及針灸師管理局過 渡委員會正式就該草案展開60天的公眾諮詢， 強調今次經修改後的草案，是盡量做到具有彈性， 以為業者提供更大的包容性。
管理局註冊總監張關亮冰昨日稱，今次經修改的 草案，比在今年3月推出的初稿，加強了彈性。 最主要的修改是「祖輩註冊」(grandparented)申 請者，必須在註冊條例正式實施時往後算計的5 年之內，在安省有至少2,000次診病次數(patient visits)，而並非之前提出的2008至2009年的時限 。至於祖輩註冊的「過渡」期限定為5年，該類 別的註冊會在註冊條例實的5年後被撤銷。祖輩 註冊會員可在這5年期之內，申請轉正成為「全 面註冊」(full registration)會員，只要能夠提 交多額外至少3年全職臨脇經驗(包括1,200次診病 次數，不限於在任何地方)的證明，以及通過「既 有學識評估」(prior learning assessment)、執 業文件審核(portfolio review)或面試評估(oral assessment)。
祖輩會員不須流利閱讀寫英語
祖輩註冊會員不須有流利閱、讀、寫的英語(或法 語)，可向管理局註冊委員會提交書面計劃(written plan)，解釋如何跟其他醫療專業及非華語病人有 效溝通，只要計劃獲接納，他們便可按計劃上的 做法來執業。其中的有效方法，就是跟另一名會 流利英語的業者一同執業。
對於在這過渡期內僅是因語言障礙而未能「轉正」 的人士，則可申請「延期」，成為有附帶條件的全 面註冊會員。管理局將按每申請者的不同情況來定 出附帶條件，譬如限制他們只可替說華語的病人 診病等。
今次跟註冊條例草案一同展開60天正式諮詢的， 還有是專業操守條例草案。這份規管業者操守的 草案，是按省衛生廳指引來制定，內容亦也跟其 他21個醫療專業的雷同。兩份草案將會在過渡委 員會的網站(www.ctcmpao.on.ca)上刊出，歡迎業 界、公眾及利益相關方透過填寫當中的反饋意見表 格來提交意見。表格須以郵寄、傳真或電郵方式， 在稍後11月9日式之前送回過渡委員會。 張關亮冰稱，在進行過今次60天的諮詢後，如草 案沒有太大爭議、不需重大修改的話，它將交到省 衛生廳作內部審核，然後通過省議會的立法程序， 預料這需時12至18個月。
全加中醫藥針灸協會代理會長孫霄冰昨日對經修 改的註冊例條草案加強彈性表示歡迎。他說，該 草案相比起在最初推出時，的確賦予更大的彈性， 是更貼近業界的訴求，該協會屬下的立法組將就 草案進行研討，把握這60天的諮詢期提交意見。
安省中醫聯合會昨日則發表聲明，除了繼續質疑 過渡委員會本身的合法性外，並表示會不承認委 員會所制定的所有條例，將會繼續他們的反對及 抗爭活動。

安省中醫師及針灸師管理局過渡委員會於2日發布 消息指出，由過渡委員會擬定出的「註冊規章草案 與專業失職規章草案」，已進入為期60天的公眾諮 詢期，若草 案內容在限期之內無重大修改，將正式 進入行政部門的立法程序。此外，過渡委員會在草 案中所最新提出的內容成為立法，欲以祖輩法申請 成為正式會員資格的部 份，其申請條件亦比以往較 為彈性。
過 渡委員會在2日舉行的記者會上指出，依「法定 醫療護理專業法」﹙簡稱RHPA﹚要求，過渡委員 會將會以郵寄，或民眾可上網自行下載草案內容及 意見表，並將 意見及建議事項以郵寄、傳真、或電 子郵件的方式，於11月9日前寄回過渡委員會。若 有重大修改，經過渡委員會修改過的草案將會再一 次進入為期60天的公眾 諮詢。一旦過渡委員會通 過規章草案，則規章將被遞交安省衛生及長期護理 廳﹙簡稱MOHLTC ﹚審閱，並等待立法部門批准。
過渡委員會註冊總監事張關亮冰強調，在寄回的意 見表中，若有太多不必要的文字敘述，過渡委員會 將會做適當的規納及總結，同時在翻譯的過程，也 許會出現語意表達的出入，但過渡委員會將盡其所 能的把所收到的意見表做完整的表達。
依 據過渡委員會修定之草案，目前所有已執業者， 將可由祖輩註冊程序被考慮納入成為正式會員﹔以 祖輩註冊的會員，在五年內若通過既有學識評估和 認可 ﹙Prior Learning Assessment and Recognition ﹚，可成為正式會員，若英文程尚須加強者，可申請延長期限，但 延長時間須依個案由過渡委員會決定。
此外，過渡委員會就反對意 見人士指責目前過渡委 員會委員人數僅5人的合法性做出說明。過渡委員 會陳述指出，被任命的過渡委員會數目是經由安省 衛生及長期護理廳慎重選擇且被政府認 可，無最少 或最多委員數的規定。不論成員數目，過渡委員會 皆有權力運作並執行「中醫法，2006」範圍內之事 務。

Consultation on Draft Registration Regulation and Professional Misconduct RegulationSeptember 2, 2010Our current consultation is on the draft Registration Regulation and Professional Misconduct Regulation. These draft regulations are now being circulated to practitioners in traditional Chinese medicine practices who had provided their contact mailing addresses to the transitional Council, professional TCM associations, other regulatory health colleges, other provincial TCM regulatory colleges, the Office of the Fairness Commissioner, and stakeholders on our mailing database. They are also being posted on the consultation section of our website. When reviewing the draft regulation, please reference the explanation and rationale provided for each provision. They will help you understand the background and reasons for proposing each of the provisions and whether it is consistent with Ministry policies, in keeping with the (RHPA) and the public interest. We also like to bring to your attention that parts of draft Registration Regulation have been amended to incorporate comments received from practitioners, the public and key stakeholders as a result of our preliminary consultation earlier in the year.
